Who the parties are
Aikaya provides the technology and hosting. Each purchase is a sale by the creator, who is the seller of the content; you, the buyer, are the creator’s customer. [DECISION: confirm merchant-of-record — our 0%-fee Connect setup points to the creator as seller; this sets VAT and refund duty.]
Accounts and sign-in
You sign in with your email and a magic link — there are no passwords. One account per person. Administrator access is internal and protected by a second factor.
If you are a creator
You confirm you own or are licensed to use everything you upload, and you are responsible for its legality. You are responsible for your own health and safety guidance: we provide a mandatory baseline disclaimer that you cannot remove, and you add your own specifics. You grant us the licence needed to host, transcode, and stream your content to your buyers.
If you are a buyer
A purchase grants you a personal, non-transferable licence to watch the content. You may not download or redistribute it. Audio-only playback is the same licensed content at a lower bandwidth.
The 12-month access guarantee
When you buy content, you keep access to it for at least 12 months from purchase, and for longer while it stays published — including if the creator later leaves the platform. The one exception is deleting your own account: if you erase your identity there is no longer a login to reach your purchases, so your own access ends (your purchase record is kept, anonymised, for our legal retention period).
Prices, currency and tax
Creators set prices, shown in a single currency per product and always calculated on our servers. Stripe calculates and handles tax and VAT; we store payment references only, never card details.
EU right of withdrawal (14 days)
Because content is delivered to you immediately, at checkout you expressly agree that performance begins at once and you acknowledge that you lose the usual 14-day right of withdrawal for that purchase. We record this agreement with your order. [DECISION: counsel to word the checkout affirmation.]
Refunds and cancellation
See our Refund policy. A subscription cancels at the end of the paid period and stays active until then; we do not refund part-used periods unless the content was faulty.
Delivery and fair use
Playback is subject to reasonable rate limits. On paid plans, delivery beyond the plan’s monthly allowance is billed as overage at €0.015 per GB. On the Free plan, playback is blocked once the allowance is reached.
Creator plans
Creators choose Free, Starter, Pro, or Studio. Annual billing is ten times the monthly price (two months free); allowances are per month regardless of billing interval. Upgrades take effect immediately; downgrades take effect at the end of the current period.
Leaving, dormancy and content deletion
If a creator leaves or deletes their account, their shop winds down: the storefront becomes inactive and no new sales are taken, but existing buyers keep access under the 12-month guarantee, and any outstanding payout balance is settled first. Content is only reclaimed after the guarantee window.
We also reclaim abandoned content on a schedule: an unpublished draft untouched for 60 days is flagged, and deleted if still untouched at 90 days; a creator who has not signed in for 6 months and has never made a sale is warned twice, with download links, before their library is deleted at 12 months. We never delete content anyone has paid for, and paid-plan creators are exempt from the dormancy stages while subscribed.
Acceptable use
You may not upload illegal, infringing, or harmful content. We operate a notice-and-takedown process and may remove content or suspend accounts for breach or abuse.
Health, safety and liability
The service is provided “as is” within the limits the law allows. Our Medical disclaimer is part of these Terms: breathwork carries real risks, and several practices are contraindicated in pregnancy and for some conditions. As an intermediary, we are not responsible for creators’ content beyond our role in hosting and delivering it.
